Terms of Service

Welcome to ScaffVision Site. These Terms of Service ("Terms") govern your access to and use of the software, services, mobile applications, and dashboard tools provided by Scaff Vision ("ScaffVision", "we", "us", or "our"). By registering for a pilot, creating an account, or subscribing to our plans, you ("Customer", "you", or "your") agree to be bound by these Terms.

1. Agreement to Terms

By executing an order form, booking a site survey, registering for a 30-day pilot, or accessing the website and SaaS application, you represent that you have the authority to bind your organization (e.g., EPC contractor, developer, or subcontractor) to these Terms. If you do not agree to these Terms, you must not access or use the services.

2. Description of SaaS Services

ScaffVision Site provides a cloud-based AI safety and scaffolding intelligence platform that connects to customer-provided IP camera feeds (via RTSP) and batch drone footage. Key capabilities include:

  • Real-time AI PPE detection (helmets, vests, harnesses, and safety footwear).
  • Structural scaffolding risk analysis (joint alignments, plates, and bracing).
  • Automated scaffolding inventory counting.
  • Digital checklists, incident logging, and audit-ready report generation.

3. Subscription Plans, Billing & Fees

Customer agrees to pay all fees associated with their selected plan (Basic, Pro, or Enterprise) as set forth in the pricing section or custom order form.

  • Basic Plan: Charged at ₹4,999 per active site per month, covering up to 5 connected camera zones and digital checklists.
  • Pro Plan: Charged at ₹11,999 per active site per month, covering unlimited camera zones, AI PPE monitoring, structural risk analysis, daily inventory, and WhatsApp notifications.
  • Enterprise Plan: Custom billing per project, covering multi-site management, drone integrations, custom report templates, and dedicated onboarding support.
  • Add-ons: Customer may purchase additional camera zones (₹499/mo), drone batch analysis (₹2,999/mo), custom templates (₹9,999 one-time), or on-site setup (₹14,999 one-time).
  • Billing Cycles & Taxes: All subscriptions are billed monthly in advance and are subject to applicable taxes (including GST). Deactivation of a site requires 30 days written notice before the next billing cycle.

4. Customer Obligations & Camera Hardware

Customer is solely responsible for providing compatible camera systems, DVR/NVR encoders, and site internet connectivity. Specifically:

  • Camera streams must meet the minimum 720p resolution for PPE detection, and 1080p for inventory or structural checks.
  • Customer must provide secure RTSP access or camera credentials necessary for ScaffVision to connect remotely to the feed.
  • Customer must secure all necessary permissions, employee consents, and local regulatory clearances to capture and process live site footage.

5. AI Accuracy & Structural Safety Disclaimer

Customer explicitly acknowledges and agrees to the following regarding our AI models:

  • No Professional Guarantee: ScaffVision Site is an automated monitoring assistance tool. The AI models are calibrated to identify common safety anomalies, but do not guarantee 100% accuracy. Detections are subject to camera angles, lighting conditions, dust, weather, and motion blur.
  • No Structural Certification: The structural scaffolding risk flagging (joint misalignment, missing base plates, etc.) is a helper tool to spot visual warnings. It does not replace physical inspections, certifications, or regulatory checks by a certified structural engineer. Customer remains solely liable for scaffolding construction safety, load-bearing capacities, and compliance with IS 3696 standard guidelines.

6. Intellectual Property Rights

ScaffVision retains all right, title, and interest in and to the SaaS application, the underlying computer vision models, custom-trained neural network weights, algorithms, API endpoints, dashboards, and all associated software. Customer is granted a limited, non-exclusive, non-transferable license to access the dashboard and mobile application solely for monitoring their designated sites during the subscription term.

7. Prohibited Uses

You agree not to: (a) reverse engineer, decompile, or disassemble any part of the ScaffVision AI models; (b) share your login credentials or allow unauthorized third parties to access the dashboard; (c) scrape or download event photos or data streams to build competitive safety monitoring software; or (d) input false or misleading information in checklists or incident logs.

8. Limitation of Liability

To the maximum extent permitted by applicable law, ScaffVision Private Limited, its directors, employees, or affiliates, shall not be held liable for:

  • Any physical accidents, bodily injuries, illnesses, or worker fatalities occurring on the customer's construction sites.
  • Any material collapses, scaffolding structural failures, or damage to equipment.
  • Any government fines, regulatory stop-work orders, or delays in construction schedules, even if ScaffVision failed to flag a safety violation prior to the incident.
  • Any indirect, incidental, special, or consequential damages arising out of the use or inability to use the platform.

Our total cumulative liability for any claim arising out of these Terms shall not exceed the total amount paid by the Customer to ScaffVision in the three (3) months preceding the event giving rise to the claim.

9. Indemnification

Customer agrees to indemnify, defend, and hold harmless ScaffVision and its officers, directors, and developers from and against any third-party claims, lawsuits, damages, or losses (including attorney fees) arising from: (a) Customer's violation of these Terms; (b) Customer's site activities, scaffolding construction, or safety management; or (c) any incident or safety violation occurring on the Customer's site.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms, including their validity, invalidity, breach, or termination, shall be subject to the exclusive jurisdiction of the competent courts located in Aurangabad, Maharashtra, India.
